The Equality Act

The Equality Act 2010 sets out the personal characteristics that are protected by the law and the behaviour that is unlawful. These are the main forms of prohibited conduct under the Equality Act 2010:

Discrimination - Direct discrimination means treating a person less favourably than someone else because of a protected characteristic. Indirect discrimination means putting in place a rule or way of doing things that have a less favourable impact on someone with a protected characteristic than someone without one when this cannot be objectively justified.

Harassment - Harassment means unwanted conduct which has the purpose or effect of violating someone’s dignity or which is hostile, degrading, humiliating or offensive to someone with a protected characteristic or in a way that is sexual in nature.

Victimisation - Victimisation means treating someone unfavourably because they have taken (or might be taking) action under the Equality Act or supporting somebody who is doing so. All three requirements apply to employers and those providing services and performing public functions. Employers only owe a duty to make reasonable adjustments for individual employees when they know, or should reasonably know, of their disability. Providers of services and public functions, however, owe a duty to all potential users and the duty for.

Everyone in Britain is protected by the Equality Act. The “protected characteristics” under the Act are (in alphabetical order):

  • Age
